WHAT IS MEDIATION?
Mediation or sometimes referred to as alternative dispute resolution is a fantastic tool for resolving complicated legal disputes. Today, mediation is used in almost every area of the court and tribunal system.
Mediation can also be used even prior to a dispute going to court. For example, many married couples who are looking to divorce amicably will resort to mediation. If they finalize an arrangement agreeable to all they will avoid unnecessary and prolonged court battles.
Sometimes, mediation is used during the court process. For example, prior to a trial parties will look to mediate the dispute.
There is absolutely no shame in considering mediation. Some litigants will complain that their lawyer is looking to mediate because they don’t want to go to trial. This couldn’t be farther from the truth. Mediation has proved over and over to be a valuable tool that has resulted in the settlement of numerous cases.
A practical solution is to find a third party mediator with experience to mediate the dispute. If cost is an issue then consider a mediator that provides competitive rates. Selecting an impartial lawyer to mediate a dispute is an excellent idea. An experienced mediator who is also an experienced lawyer can provide detailed insight into the legal system.
